Terms and Condition of Sale

WARRANTIES: Seller warrants that the material furnished here under is of the grade, size, configuration and properties ordered by Buyer and Seller makes no other warranty either expressed or implied. Any liability of Seller to Buyer shall be limited and shall not exceed the price of the item on which such liability is based.

ADVICE: Any statement or advice (including but not limited to advice regarding the quantity of goods necessary for a particular job, or the suitability of a particular product for a particular use) is provided solely as a courtesy to Buyer and is not guaranteed.

FREIGHT DAMAGE, CLAIMS, RETURNS & RE-STOCKING FEE: Buyer agrees to check material received against shipping papers “immediately” upon delivery at destination. Freight damage must be reported to carrier on delivery paperwork at time of delivery and Wulus Distribution needs to be notified within 48 hrs. Most freight carriers will not cover freight damage if it is not noted on paperwork at time of delivery. All Buyers’ claims must be reported to Seller within 10 days after Buyer’s receipt of material. Claims will not be honored, unless Seller is given ample opportunity to investigate such claims. All returns or exchange must be done within 30 days after delivery. Any return or exchange request done beyond 30 days after delivery will not be honored. All returns or exchange requires a Return Merchant authorization(RMA) number. Seller will replace at the delivery point specified herein or allow credit for the price of any material that is found by Seller to be defective and Seller is not responsible for any other direct or consequential damage claimed by Buyer as a result of any such defect or failure.

Items that have been identified as “Factory Special, “or “Non-Cancelable/Non-Returnable” will not be considered for return. (These parts will be properly identified on order confirmation). Any item that is not stocked locally in the US and is shipped from outside the US is not returnable. Only items received in the last 30 days will be considered for a return. All items considered for return must be in its original unopened packaging, with bar code (when applicable) and in new condition. This includes items that are shipped in sealed plastic bags within its original packaged container. Customer must be in “Good Credit” standing, to be considered for return.  An RMA number will be provided for return processing once the delinquent account has returned to “Good Credit” status. An RMA number will provided upon receipt of a valid transaction number, Purchase Order number or Invoice number. An RMA number will not be provided if guidelines above have not been met. All items returned to Wulus Distribution must be accompanied by an authorized Return Material Authorization (RMA) number. Issuance of an RMA number does not ensure issuance of a credit.  Credits will be issued upon receipt and inspection of items. Any items that do not fulfill requirements above, even with a provided RMA, will be returned and no credit will be issued. All line items approved for return are subject to a 30% restocking fee. All line items approved for return will receive credit in the form of a credit invoice, which will be applied to future purchases. If requesting a cash refund, please send the request to accounting@wulusdistribution.com, with the corresponding credit invoice number. Cash refunds are within the sole discretion of Wulus Distribution. Any change or modification to this policy is subject to the discretion of Wulus Distribution and explicit approval by assigned approving authority.

DELIVERIES: Shipping dates given in advance of actual shipment are estimated based on information received from our suppliers and shall not be deemed to represent fixed or guaranteed shipping dates. Delivery dates are not guaranteed and Seller shall not be liable to Buyer or the ultimate user for any claims arising from delay in shipment or delivery.

QUOTATIONS: All quotations are subject to change without notice, unless otherwise stated in writing, in a Quotation. Orders, whether or not placed on the basis of any quotation, are subject to Seller’s acceptance.

TAXES: Any excises, levies or taxes which the Seller may be required to pay or collect, under any existing or future law, upon or with respect to the sale, purchase, delivery, storage, processing, use, consumption or transportation of any of the material covered hereby, shall be for the account of the Buyer and the Buyer agrees to pay the amount thereof to the Seller upon request. For all purchases including online e-commerce purchases, Wulus Distribution only collects sales tax on orders shipped to addresses in Washington State. You may be responsible for state and local sales/use taxes when filing your tax returns. Please check your local sales tax laws.

EXPORTING – Buyer acknowledges that this order and the performance thereof are subject to compliance with any and all applicable United States laws, regulations, or orders. Buyer agrees to comply with all such laws, regulations, and orders, including, if applicable, all requirements of the International Traffic in Arms Regulations and/or the Export Administration Act, as may be amended. Buyer further agrees that if the export laws are applicable, it will not disclose or re-export any technical data received under this order to any countries for which the United States government requires an export license or other supporting documentation at the time of export or transfer, unless Buyer has obtained prior written authorization from the United States Office of Export Control or other authority responsible for such matters.

CREDIT/DEBIT CARD PURCHASES ON E-COMMERCE SITE: By using this credit or debit card to make purchases on our website, you are agreeing to our Terms & Condition of Sale and you certify that you are an authorized user of this credit or debit card and that you nor anybody will ever dispute this payment with your credit or debit card company; so long as the transaction corresponds to the item(s) purchased. Wulus Distribution or its representative will never be held responsible in any dispute resulting in the use of this credit or debit card including charge-backs. Charge-backs will never be accepted by Wulus Distribution under any circumstances and will be rejected by Wulus Distribution and its representatives.

Any change or modification to this policy is subject to the discretion of Wulus Distribution and explicit approval by assigned approving authority.
